The IIHS test are not limited to crash test only.  They also take Infiniti EX35 Luxury SUVinto account a couple of other safety criteria that must be met.  One of these is that each vehicle must have Electronic Stability Control.   Cars equipped with ESC significantly reduce the risk of a crash.  On an SUV; a feature like Vehicle Dynamic Control (what ESC is called on the EX35), can reduce the risk of a fatal single vehicle crash by 50% and a roll-over by 80% according to  IIHS.
